• Coupons are intended for personal, non-commercial use only. Reproduction, counterfeiting, resale, or commercial trading of Coupons is strictly prohibited, as is any unlawful activity involving the purchase or use of a Coupon.
METHODS OF PAYMENT
Information about accepted payment methods will be provided during the purchasing process. Certain payment methods may be subject to additional terms, conditions, or fees, as indicated in the relevant section of thecosmicelectronics.com. Payments are securely processed through third-party payment service providers. Cosmic Electronics does not directly collect or store sensitive payment information, such as credit card details, and will only receive confirmation of successful payment. RETENTION OF PRODUCT OWNERSHIP
Until the Owner receives full payment of the total purchase price, ownership of the Products ordered remains with the Owner.
DELIVERY
Deliveries will be made to the address provided by the User and in the manner specified in the order summary. Upon delivery, Users should inspect the package and report any damage, missing items, or other issues without undue delay using the contact details provided in this document or as stated on the delivery note. Users may refuse to accept a visibly damaged package. We deliver to the locations specified on thecosmicelectronics.com. Estimated delivery times will be indicated on the website or during the purchasing process. Unless otherwise stated or agreed, Products will be delivered within thirty (30) days from the date of purchase. Free delivery may be available for orders that meet the applicable minimum order value and delivery conditions. Where an order is outside our standard delivery area or is located a significant distance from our available delivery locations, additional delivery charges may apply.
FAILED DELIVERY
The Owner is not responsible for delivery errors resulting from inaccurate or incomplete information provided by the User when placing an order. The Owner is also not responsible for damage or delays that occur after the Products have been handed over to a carrier arranged by the User. If Products are not received or collected within the specified time or deadline, they may be returned to the Owner. The Owner will then contact the User to arrange a second delivery attempt or determine the next appropriate action. Unless otherwise agreed, any delivery attempt from the second attempt onward will be at the User’s expense.
USER RIGHTS
Right of withdrawal
Unless an exception applies, Users may have the right to withdraw from a purchase contract within the applicable withdrawal period, generally fourteen (14) days, without providing a reason. The conditions and procedures for exercising this right are set out in this section.
WHO THE RIGHT OF WITHDRAWAL APPLIES TO
Unless an applicable exception applies, European Consumers have a statutory right under applicable EU consumer protection laws to withdraw from contracts entered into online or otherwise at a distance within the applicable withdrawal period, without providing a reason. Users who do not qualify as European Consumers are not entitled to the withdrawal rights described in this section.
EXERCISING THE RIGHT OF WITHDRAWAL
To exercise the right of withdrawal, Users must notify the Owner clearly and unambiguously of their decision to withdraw from the contract. Users may use the model withdrawal form provided in the “Definitions” section of this document, but they may also submit their withdrawal request in any other clear and suitable manner. To meet the applicable deadline, the withdrawal notice must be sent before the withdrawal period expires.
When does the withdrawal period expire?
•For purchases of Products, the withdrawal period expires fourteen (14) days after the day on which the User, or a third party designated by the User other than the carrier, takes physical possession of the Products.
• For several Products ordered together but delivered separately, or for a single Product consisting of multiple lots or pieces delivered separately, the withdrawal period expires fourteen (14) days after the day on which the User, or a third party designated by the User other than the carrier, takes physical possession of the last Product, lot, or piece.
EFFECTS OF WITHDRAWAL
Users who validly exercise their right of withdrawal will receive a refund of all payments made to the Owner, including applicable standard delivery costs. Additional costs resulting from choosing a more expensive delivery method than the least expensive standard delivery option offered by the Owner will not be refunded. The refund will be issued without undue delay and, in any event, no later than fourteen (14) days from the date the Owner is informed of the User’s decision to withdraw. Unless otherwise agreed, the refund will be made using the same payment method used for the original transaction. Users will not be charged any fees or costs for receiving the refund.
…ON THE PURCHASE OF PHYSICAL GOODS
Unless the Owner has offered to collect the Products, Users must return or hand them over to the Owner, or to a person authorized by the Owner to receive them, without undue delay and in any event within fourteen (14) days from the date they notify the Owner of their decision to withdraw from the contract. The deadline is met if the Products are handed to the carrier or otherwise returned before the fourteen (14) day period expires. The Owner may withhold the refund until the Products are received or the User provides evidence that they have been returned, whichever occurs first. Users are responsible only for any reduction in the value of the Products resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
The User is responsible for the costs of returning the Products.
LEGAL GUARANTEE OF CONFORMITY FOR GOODS
Under applicable EU law, traders generally provide a legal guarantee that goods conform to the contract for a minimum period of two (2) years from the date of delivery. Where Users qualify as European Consumers, any applicable legal guarantee of conformity for Products purchased through thecosmicelectronics.com will apply in accordance with the laws of the country where the Consumer normally resides. The applicable national laws may provide Consumers with additional or broader rights. Consumers who do not qualify as European Consumers may have rights relating to the conformity of Products under the laws applicable in their country of habitual residence.

Indemnification
The User agrees to indemnify and hold harmless the Owner, its subsidiaries, affiliates, officers, directors, agents, partners, and employees from and against any claims, demands, damages, liabilities, costs, or expenses, including reasonable legal fees, arising from or relating to the User’s improper or unlawful use of the services, violation of these Terms and Conditions, infringement of any third-party rights, or violation of applicable laws. This obligation also applies to any actions or omissions by the User’s representatives, agents, partners, or other persons acting on the User’s behalf, to the extent permitted by applicable law.
LIMITATION OF LIABILITY
Unless otherwise explicitly stated and without prejudice to applicable statutory product liability provisions, Users shall have no right to claim damages against the Owner (or any natural or legal person acting on its behalf). This does not apply to damages to life, health or physical integrity, damages resulting from the breach of an essential contractual obligation such as any obligation strictly necessary to achieve the purpose of the contract, and/or damages resulting from intent or gross negligence, as long as CETECHBPA.com has been appropriately and correctly used by the User. Unless damages have been caused by way of intent or gross negligence, or they affect life, health or physical integrity, the Owner shall only be liable to the extent of typical and foreseeable damages at the moment the contract was entered into.
AUSTRALIAN USERS
Limitation of liability
Unless otherwise expressly stated and subject to applicable product liability laws, Users may not claim damages against the Owner or any person acting on the Owner’s behalf. This limitation does not apply to damages involving death, personal injury, or harm to physical health; damages arising from the breach of an essential contractual obligation necessary to achieve the purpose of the contract; or damages caused by fraud, intent, or gross negligence, to the extent permitted by applicable law. Where permitted by law, and except in cases involving death, personal injury, or intentional or grossly negligent conduct, the Owner’s liability shall be limited to damages that were reasonably foreseeable and typical at the time the contract was entered into.

Disclaimer of Warranties
DISCLAIMER OF WARRANTIES thecosmicelectronics.com and its services are provided on an “as is” and “as available” basis. Use of the website and its services is at the User’s own risk. To the maximum extent permitted by applicable law, the Owner disclaims all express, implied, statutory, or other warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, security, and non-infringement of third-party rights. No advice or information, whether written or oral, obtained from the Owner or through the website creates any warranty unless expressly stated in these Terms and Conditions. Indemnification The User agrees to defend, indemnify, and hold harmless the Owner, including its subsidiaries, affiliates, officers, directors, agents, partners, suppliers, and employees, from and against any claims, demands, damages, obligations, losses, liabilities, costs, debts, and expenses, including reasonable legal fees and expenses, arising from:

• the User’s violation of these Terms and Conditions, including, without limitation, any breach of the representations, warranties, or obligations set out herein;
• the User’s violation of any third-party rights, including, without limitation, privacy rights and intellectual property rights;

COMMON PROVISIONS
No Waiver

SERVICE INTERRUPTION
