DELIVERY

FAILED DELIVERY

WHO THE RIGHT OF WITHDRAWAL APPLIES TO

Unless an applicable exception applies, European Consumers have a statutory right under applicable EU consumer protection laws to withdraw from contracts entered into online or otherwise at a distance within the applicable withdrawal period, without providing a reason. Users who do not qualify as European Consumers are not entitled to the withdrawal rights described in this section.

EXERCISING THE RIGHT OF WITHDRAWAL

To exercise the right of withdrawal, Users must notify the Owner clearly and unambiguously of their decision to withdraw from the contract. Users may use the model withdrawal form provided in the “Definitions” section of this document, but they may also submit their withdrawal request in any other clear and suitable manner. To meet the applicable deadline, the withdrawal notice must be sent before the withdrawal period expires.

When does the withdrawal period expire?

•For purchases of Products, the withdrawal period expires fourteen (14) days after the day on which the User, or a third party designated by the User other than the carrier, takes physical possession of the Products.

• For several Products ordered together but delivered separately, or for a single Product consisting of multiple lots or pieces delivered separately, the withdrawal period expires fourteen (14) days after the day on which the User, or a third party designated by the User other than the carrier, takes physical possession of the last Product, lot, or piece.

EFFECTS OF WITHDRAWAL

Users who validly exercise their right of withdrawal will receive a refund of all payments made to the Owner, including applicable standard delivery costs. Additional costs resulting from choosing a more expensive delivery method than the least expensive standard delivery option offered by the Owner will not be refunded. The refund will be issued without undue delay and, in any event, no later than fourteen (14) days from the date the Owner is informed of the User’s decision to withdraw. Unless otherwise agreed, the refund will be made using the same payment method used for the original transaction. Users will not be charged any fees or costs for receiving the refund.

…ON THE PURCHASE OF PHYSICAL GOODS

Unless the Owner has offered to collect the Products, Users must return or hand them over to the Owner, or to a person authorized by the Owner to receive them, without undue delay and in any event within fourteen (14) days from the date they notify the Owner of their decision to withdraw from the contract. The deadline is met if the Products are handed to the carrier or otherwise returned before the fourteen (14) day period expires. The Owner may withhold the refund until the Products are received or the User provides evidence that they have been returned, whichever occurs first. Users are responsible only for any reduction in the value of the Products resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.

The User is responsible for the costs of returning the Products.

LEGAL GUARANTEE OF CONFORMITY FOR GOODS

Under applicable EU law, traders generally provide a legal guarantee that goods conform to the contract for a minimum period of two (2) years from the date of delivery. Where Users qualify as European Consumers, any applicable legal guarantee of conformity for Products purchased through thecosmicelectronics.com will apply in accordance with the laws of the country where the Consumer normally resides. LIMITATION OF LIABILITY

This does not apply to damages to life, health or physical integrity, damages resulting from the breach of an essential contractual obligation such as any obligation strictly necessary to achieve the purpose of the contract, and/or damages resulting from intent or gross negligence, as long as CETECHBPA.com has been appropriately and correctly used by the User. Unless damages have been caused by way of intent or gross negligence, or they affect life, health or physical integrity, the Owner shall only be liable to the extent of typical and foreseeable damages at the moment the contract was entered into.

AUSTRALIAN USERS

Limitation of liability

This limitation does not apply to damages involving death, personal injury, or harm to physical health; damages arising from the breach of an essential contractual obligation necessary to achieve the purpose of the contract; or damages caused by fraud, intent, or gross negligence, to the extent permitted by applicable law. Where permitted by law, and except in cases involving death, personal injury, or intentional or grossly negligent conduct, the Owner’s liability shall be limited to damages that were reasonably foreseeable and typical at the time the contract was entered into.
